Who these terms cover

These Terms of Use govern your access to and use of caregiverbreak.com(the “Site”), operated under a written marketing services agreement with Eli Health (Lifetime Redesign OT, PLLC), an approved participant in the CMS GUIDE (Guiding an Improved Dementia Experience) Model. By using the Site you agree to these Terms. If you disagree, please do not use the Site.

What the Site is — and isn’t

The Site is an informational and eligibility-inquiry tool. It is nota medical record, diagnostic tool, pharmacy, or clinical service. Information provided on the Site, including descriptions of the CMS GUIDE Model and Eli Health’s services, is for general information purposes and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your loved one’s physician or another qualified health provider with any questions regarding a medical condition.

Submitting the eligibility form does not enroll you or your loved one in the CMS GUIDE Model. Final eligibility and enrollment decisions are made by CMS.

Emergencies

If your loved one is in a safety or medical emergency, call 911. For 24/7 dementia support from a trained specialist, call the Alzheimer’s Association Helpline at (800) 272-3900. The Site is not an emergency service and does not provide 24/7 pre-enrollment clinical support.

Accurate information

You agree to provide accurate and current information on the eligibility form and to update it if it changes. Providing false information about a third party (including your loved one) without their consent is not permitted.

Communications consent

By submitting the eligibility form you agree to the communications described in the TCPA consent box and footer: calls, texts, and emails from Eli Health and its marketing partner regarding the CMS GUIDE Model, including via autodialer and prerecorded message. You may revoke consent at any time by replying STOP to any text, clicking unsubscribe in any email, or emailing privacy@elihealth.com. Revocation will be honored as required by applicable law.

Intellectual property

The Site, including its text, design, logos, photography, and software, is protected by copyright, trademark, and other laws. Eli Health and its licensors retain all rights. You may not copy, redistribute, or create derivative works without written permission.

Disclaimers

The Site is provided “as is” without warranties of any kind. We do not warrant that the Site will be uninterrupted, error-free, or that information is complete or current. We do not guarantee eligibility for or enrollment in the CMS GUIDE Model; that determination rests with CMS.

Limitation of liability

To the maximum extent permitted by law, neither Eli Health, its marketing partner, nor their affiliates will be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Our aggregate liability for any direct damages is limited to the greater of $100 or the amount you paid us (which is ordinarily $0, since Site use is free).

Governing law

These Terms are governed by the laws of the State of Missouri, where Lifetime Redesign OT, PLLC is organized, without regard to its conflict-of-law principles. Any dispute will be brought exclusively in state or federal courts located in St. Louis County, Missouri, except where applicable consumer-protection law preserves your right to a different venue.

Changes to these terms

We may update these Terms from time to time. Material changes will be noted at the top of this page with a new “Last updated” date. Continued use of the Site after an update constitutes acceptance.
